1. General Information

These Terms & Conditions ("T&C") outline the policies for engaging with the services, promotions, and offers provided by OnPoint Fencing and Decking ("we," "us," or "our"). By engaging with our services or accepting our offers, you ("Customer" or "You") agree to these T&C.

2. Property Lines and Fence Responsibility

• Property lines and fence lines are the sole responsibility of the property owner/customer.
• If your project involves a neighboring property, the customer must come to an agreement on style, product, service, and schedule before signing the contract.
• Customers are responsible for notifying neighbors of the project start date and ensuring the property line is clear, pets are enclosed, and belongings are removed along fence lines.

3. Utilities and Site Conditions

• OnPoint Fencing and Decking will submit a request to locate public utilities such as water, gas, power, and communication.
• Damage to underground obstructions (e.g., public/private utilities) is the sole responsibility of the owner/customer. Please notify OnPoint of any issues with the locate services.
• Concealed conditions (e.g., rocks, boulders, root systems, construction debris) may require additional labor or material charges to complete the project. OnPoint reserves the right to bill for reasonable costs incurred.

4. Project Changes and Adjustments

• Any alterations, adjustments, or deviations from the signed quote require a Change Order Form signed by both the Client and an OnPoint Representative.
• Amendments to the contract may result in additional fees.
• Material cost increases exceeding 5% give OnPoint the right to adjust pricing accordingly.

5. Permits and Regulations

• All permits, variances, or deviations from state, county, or city ordinances are the responsibility of the customer.
• Permit assistance for deck projects can be provided for an additional fee.
• Customers should review Oregon law for construction contracts at www.oregon.gov.ccb.

7. Site Conditions and Debris Removal

• Soil and debris dug from holes will be spread throughout the property unless otherwise agreed. OnPoint does not haul away dirt without proper charges.
• Customers must remove personal items in the work area to prevent damage. The work area will be considered a high-traffic construction zone.
• Clearing fence lines (e.g., vines, debris, rocks, trees) is the responsibility of the customer unless explicitly agreed upon and noted in the job description.
• Lawn damage due to natural conditions (e.g., wet ground) is the customer's responsibility.
• OnPoint will remove all construction trash, waste, and debris created during the project.

8. Estimates, Payment, and Cancellations

• Estimates are valid for 7 days.
• To finalize the project, the customer must: Sign the contract. Pay a 50% deposit (unless otherwise agreed).
• Full refunds for deposits require a 2-week cancellation notice prior to the scheduled project date.
• Balances are due within 7 business days of project completion.
• Unpaid balances: Will incur a 5% monthly fee, charged daily until the balance is settled.
• Balances beyond 30 days may result in legal action, such as a lien.
• Returned checks will incur a $50 fee.

9. Scheduling and Delays

All time agreements are contingent upon weather, accidents, supply fulfillment, or other conditions beyond OnPoint's control.

10. Liability Limitations

OnPoint Fencing and Decking is not liable for:

• Pre-existing property damage.
• Site conditions or complications beyond our control.
• Delays caused by weather, supply chain disruptions, or uncontrollable factors.

Customers agree to hold OnPoint harmless from the above circumstances.

11. Promotions and Offers

• Promotions and offers are subject to change or discontinuation at any time.
• Offers cannot be combined with other discounts or promotions unless explicitly stated.
• Bonuses included in promotions hold no cash value and are non-transferable.

12. Privacy Policy

• Personal information collected will only be used to deliver services, send promotional communications, and improve offerings.
• We do not sell or share personal information with third parties unless necessary to fulfill services or comply with legal obligations.
• Customers can opt out of marketing communications at any time.

13. Governing Law and Dispute Resolution

• These T&C are governed by the laws of the State of Oregon.
• Disputes will be resolved exclusively in the courts of Willamette Valley unless alternative dispute resolution (e.g., mediation or arbitration) is mutually agreed upon.

14. Updates to Terms & Conditions

OnPoint Fencing and Decking reserves the right to update or modify these T&C at any time. Customers are encouraged to review the latest version on our website or request a copy.

15. Acceptance of Terms

By approving the estimate or engaging with our services, you acknowledge that you have read, understood, and agree to these Terms & Conditions, including applicable laws under ORS Chapters 87 and 701.
